5. Payment Terms

5.1 Pricing

The total amount charged to you will be displayed at checkout prior to the completion of your order.

5.2 Payment Methods

Pizza Luce accepts payment via major credit cards, debit cards, and other payment methods as indicated at checkout. By submitting payment information, you represent and warrant that (a) the payment information you supply is true, correct, and complete; (b) you are authorized to use the payment method provided; and (c) charges incurred will be honored by the relevant financial institution.

5.3 Order Confirmation

An order is not confirmed until you receive an email or on-screen confirmation from Pizza Luce. We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to situations where items are out of stock, there are errors in pricing or product information, or we suspect fraudulent activity.

5.4 Refunds and Cancellations

Due to the perishable nature of food products, all sales are generally final once an order has been prepared. If you have an issue with your order—such as receiving an incorrect item, a missing item, or a quality concern—you must contact us within twenty-four (24) hours of delivery or pickup at [email protected]. We will review your claim and, at our discretion, offer a replacement, store credit, or partial refund. Chargebacks initiated without first contacting Pizza Luce may result in account suspension.

5.5 Taxes

You are responsible for paying all applicable federal, state, and local taxes associated with your purchase. Sales tax will be calculated and displayed at checkout based on your delivery address and applicable tax rates.

6. Delivery Terms

Delivery times are estimates and are not guaranteed. Pizza Luce is not liable for delays caused by factors outside our reasonable control, including but not limited to traffic, weather conditions, or third-party delivery partner issues. You are responsible for ensuring that the delivery address you provide is accurate. Pizza Luce will not be responsible for failed deliveries resulting from incorrect or incomplete address information provided by the customer.

Delivery is available only within designated service areas. Delivery minimums and fees may apply and will be displayed at checkout. Upon delivery, risk of loss and title for food items pass to you at the point of delivery to the address you have provided.

7. Intellectual Property Rights

All content available on or through the Site, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, menu designs, brand elements, and software, is the exclusive property of Pizza Luce or its content suppliers and is protected by applicable United States and international intellectual property laws, including the Copyright Act (17 U.S.C. § 101 et seq.) and the Lanham Act (15 U.S.C. § 1051 et seq.).

The "Pizza Luce" name, logo, and all related marks, product and service names, designs, and slogans are trademarks of Pizza Luce. You may not use such marks without our prior written permission. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site and its content solely for personal, non-commercial purposes in connection with placing food orders and using our Services. This license does not include the right to:

  • Download or copy account information for the benefit of another merchant;

8. Disclaimers and "As-Is" Basis

9. Limitation of Liability

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability for consequential or incidental damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by applicable law.

10. Indemnification

You agree to defend, indemnify, and hold harmless Pizza Luce and its respective officers, directors, employees, agents, contractors, licensors, affiliates, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

14. Dispute Resolution

14.1 Informal Resolution

Pizza Luce will use commercially reasonable efforts to respond within thirty (30) days. If the dispute is not resolved within sixty (60) days of the initial contact, either party may proceed to formal dispute resolution as set forth below.

Except for claims that qualify for resolution in small claims court, any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be finally resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules, which are available at www.adr.org. The arbitrator shall have authority to award any relief that would be available in a court of law, but shall not have authority to award damages in excess of the limitations set forth in these Terms. 14.3 Class Action Waiver

YOU AND PIZZA LUCE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you waive any right to a jury trial and both parties waive any right to participate in a class action lawsuit.

14.4 Small Claims Court

Notwithstanding the foregoing, either party may bring an individual action in small claims court in the appropriate jurisdiction, provided that the claim is within the court's jurisdictional limits and remains an individual claim.

15. Term and Termination

These Terms shall remain in full force and effect while you use the Site or Services. Pizza Luce reserves the right, in its sole discretion, to:

  • Suspend or terminate your account and access to the Services at any time, with or without cause, and with or without notice;
  • Refuse service to any person for any reason not prohibited by applicable law;

In such events, Pizza Luce will use commercially reasonable efforts to resume normal operations as soon as practicable.
